1. Description of Service

FestAndPlay is a web-based rhythm game that allows users to play community-created beatmaps, generate custom maps via an AI mapper, and track their gameplay progression.

2. Intellectual Property and Copyright

• The Application: The FestAndPlay interface, code, graphics, and original assets are owned by the developers of FestAndPlay.
• Third-Party Content: FestAndPlay acts as a client interface. The beatmaps, track audio previews, and cover art are fetched from the third-party platform BeatSaver. FestAndPlay does not host, distribute, or claim ownership of any copyrighted music, tracks, or beatmaps accessed through the BeatSaver API.
• Lyrics: Song lyrics are fetched in real-time from LRCLIB and are the property of their respective copyright holders.
• User-Uploaded Audio: When using the AI Mapper, you are required to use audio files that you legally own or have the right to use. You acknowledge that FestAndPlay processes these files locally on your device and does not host or distribute your audio files. You are solely responsible for ensuring that your use of audio files complies with all applicable copyright laws.

3. Virtual Currency and Items

FestAndPlay features virtual currency ("Fest Coins") and virtual items (Titles, Avatars, Stages). These items have no real-world monetary value, cannot be exchanged for real money, and are entirely for in-game progression and cosmetic purposes. We reserve the right to modify, manage, or remove virtual items or currencies at any time without liability.

4. User Conduct

You agree to use FestAndPlay for personal, non-commercial entertainment purposes. You agree not to:

• Exploit bugs or use automated scripts/cheats to unfairly gain Fest Coins, high scores, or manipulate quests.
• Attempt to disrupt, overwhelm, or reverse-engineer the cloud database (Firebase) or the third-party APIs (BeatSaver, LRCLIB).

5. Public Profiles (Social)

By signing in, your profile becomes public in the Social tab. Other players can find you by display name or User ID and view your public information (display name, avatar, title, stats and recent plays). You may change your public display name at any time from Settings. If you don't want a public profile, please continue as Guest instead of signing in.

6. Disclaimer of Warranties

FestAndPlay is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the availability, accuracy, or uninterrupted functionality of the game. Because the game relies heavily on third-party APIs (such as BeatSaver), we cannot guarantee that tracks will always be available or playable.

7. Limitation of Liability

To the maximum extent permitted by law, the developers of FestAndPlay shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the application, including but not limited to data loss (e.g., lost save files or setlists).

8. Modifications to the Service

We reserve the right to modify, update, or discontinue the FestAndPlay service (or any part thereof) at any time without notice.

1. Information We Collect

We collect information to provide and improve our rhythm game experience. The data we collect depends on how you use FestAndPlay (Guest vs. Signed-In User).

• Guest Users: If you play as a guest, your gameplay progression (scores, favorites, setlists, virtual coins, settings) is stored locally on your device using your browser's Local Storage. We do not collect personal identifying information from guest users.
• Registered Users (Google Sign-In): If you choose to sign in using your Google account to enable Cloud Sync, we collect your basic profile information provided by Google (Display Name, Profile Picture URL, and a unique User ID).
• Gameplay Data: For signed-in users, we sync your gameplay data to our secure cloud database (Firebase Firestore). This includes your play history, high scores, virtual coin balance, unlocked shop items, equipped avatars/titles, and customized settings.
• Third-Party Integrations: If you choose to connect your Last.fm account, we store your Last.fm session token locally and your Last.fm username to enable "scrobbling" (sending your play history to Last.fm).

2. How We Use Your Information

We use the collected data for the following purposes:

• To provide seamless Cloud Sync across your devices.
• To track your in-game progression, quests, and rewards.
• To personalize your profile with avatars and titles.
• To analyze general gameplay trends and improve the application.

3. The AI Mapper & Audio Files

FestAndPlay features an "AI Mapper" that allows you to generate custom rhythm maps from your own audio files (MP3/WAV). We do not collect, store, or upload your audio files. All audio processing and beat analysis happens locally on your device within your web browser. Only the generated map metadata (the text-based layout of the notes) is saved to your local storage or synced to your cloud account.

4. Third-Party Services

FestAndPlay relies on third-party APIs to function. By using our app, you also interact with these services:

• Firebase / Google Cloud: Used for authentication and cloud database syncing.
• BeatSaver: We fetch community-created beatmaps, audio previews, and cover art directly from BeatSaver's public API.
• LRCLIB: We fetch synchronized lyrics for songs from the LRCLIB API.
• Last.fm: Used for tracking your music listening history (if explicitly connected by you).
• Google Analytics: Used to measure traffic and app performance.

5. Public Profiles (Social Tab)

All FestAndPlay accounts are public by default. When you sign in, a profile document is created in our cloud database (Firebase Firestore) containing:

• Your public display name (editable in Settings) and User ID.
• Your equipped avatar and title.
• Aggregate gameplay stats (total plays, max combo, note counts) and your most recent plays.

This information is visible to any other signed-in FestAndPlay user via the Social tab. Private information such as your Google email, favorite songs list, saved setlists and settings are never shared publicly. You can change your public display name at any time from Settings, or request full account deletion by contacting us. If you don't want a public profile at all, please use FestAndPlay as a Guest.

6. Data Security & Storage Limits

We implement appropriate security measures to protect your synced data via Google Firebase. Please note that cloud save data is subject to size limits (e.g., 1MB per user document). If you exceed this limit (usually due to saving too many custom AI maps), cloud syncing will be temporarily paused until space is freed.

7. Your Rights

If you are a signed-in user, you can request the deletion of your account and all associated cloud data at any time by contacting us: boogiedown262@gmail.com
